Effective date: September 30, 2026 · Last updated: September 30, 2026
These Terms and Conditions (the “Terms”) are a binding agreement between you and Via Pay, LLC, doing business as Transi (“Transi,” “we,” “us,” or “our”). They govern your use of the Transi mobile application (the “Transi App”), our website at https://transiapp.com/, and the related services we provide (together, the “Services”). Please read them carefully. By accepting them, you agree to be bound by them.
1.1 Transi’s role. Via Pay, LLC, doing business as Transi, is a money services business registered with the Financial Crimes Enforcement Network (FinCEN), NMLS ID 2493750. Transi operates the technology platform through which you create an account, request a money transfer, and communicate with us. Transi is not a bank. The Services are not deposit accounts and are not insured by the Federal Deposit Insurance Corporation (FDIC).
1.2 The Licensed Transmitter. The money transmission services are provided by Spectrum Global Payment Solutions, Inc., a licensed money transmitter, or any successor or replacement licensed money transmitter we identify to you (the “Licensed Transmitter”). The Licensed Transmitter receives, holds, and transmits the funds for your transfers. The Licensed Transmitter for your transfer is identified in the Transi App, in the pre-payment disclosure you receive before you pay, and on your receipt.
1.3 Two sets of terms. To send money you must accept these Terms and the terms and conditions of the Licensed Transmitter (the “Licensed Transmitter Terms”), both of which are presented to you in the Transi App. These Terms govern your use of the Transi App, your Transi account, our customer support, our communications with you, and our handling of your information. The Licensed Transmitter Terms govern the money transmission service, including the handling of your funds. If these Terms and the Licensed Transmitter Terms conflict about the money transmission service, the Licensed Transmitter Terms control. In general, the Licensed Transmitter is responsible for the money transmission service and for the regulatory matters that come with it, such as cancellations, refunds, errors, and complaints about your transfer. Transi is responsible for the Transi App, your Transi account, customer support, and the handling of your information. Your receipt shows how to contact each of us. Nothing in either set of terms reduces the rights that federal or state law gives you.
1.4 What Transi does not do. Transi does not act as your agent, trustee, or escrow agent, does not guarantee the identity of any person you transact with, does not determine whether you owe any tax, and does not collect or pay taxes on your behalf.
2.1 Acceptance. You accept these Terms when you accept them in the Transi App while creating your account. If you do not agree, do not create an account or use the Services. We keep a record of each acceptance, including the version of the document, the date and time, and the device used.
2.2 Personal use only. The Services are for personal, family, or household use. You may not use them for business or commercial purposes.
2.3 Changes. We may change these Terms. For material changes we will give you at least thirty (30) days’ notice by email, in the Transi App, or by posting on our website, unless a shorter period is required or permitted by law, for example to address a security risk or a legal requirement. A change applies to your future use of the Services and does not change a transfer you have already paid for. If you do not agree to a change, you may stop using the Services and close your account (Section 16). Where the law requires your affirmative consent to a change, we will ask for it before the change applies to you.
2.4 Where to find these Terms. You can view the current Terms in the Transi App at any time and download or print a copy.
3.1 Your consent. You consent to receive electronically all disclosures, notices, receipts, agreements, and other communications about the Services, including the pre-payment disclosures and receipts required by federal and state law (“Electronic Records”), and to sign and accept documents electronically. This consent applies to all Electronic Records related to the Services until you withdraw it.
3.2 How we deliver them. We may deliver Electronic Records in the Transi App, by email to the address in your account, by text message or push notification that tells you how to view them, or on our website. You should keep your email address and mobile phone number up to date.
3.3 Paper copies. You have the right to receive any Electronic Record on paper. To request a paper copy, contact us as described in Section 26. We do not charge a fee for a paper copy.
3.4 Withdrawing your consent. You may withdraw your consent at any time by contacting us as described in Section 26. Withdrawal does not affect the validity of anything you signed or received before you withdrew. Because we cannot provide the Services without electronic delivery, we may close your account when you withdraw your consent, and we will complete or cancel any transfer in progress as these Terms provide.
3.5 What you need. To access Electronic Records you need a smartphone, tablet, or computer with internet access, a current version of its operating system and browser, an email address, and software that can open PDF files. If these requirements change in a way that creates a material risk that you could not access Electronic Records, we will tell you, and you may withdraw your consent without a fee.
3.6 Your confirmation. By accepting the electronic communications consent in the Transi App, you confirm that you can open and view Electronic Records in the formats we use.
4.1 Age and capacity. You must be at least eighteen (18) years old and able to form a legally binding contract to create an account or use the Services.
4.2 Residence and location. The Services are available only to residents of the United States who are located in the United States when they use the Services, and only in the states where the Licensed Transmitter is authorized to provide them, as shown in the Transi App.
4.3 One account. You may have only one active account. If we find that you have more than one, we may merge or close the accounts or limit your use of the Services.
4.4 Restricted persons. You may not use the Services if you are on a list of persons subject to sanctions administered by the U.S. Office of Foreign Assets Control (“OFAC”) or similar government lists, or if you live in, work in, or are organized under the laws of a jurisdiction subject to comprehensive U.S. sanctions.
4.5 Device location. You authorize us to use the location of your device to confirm that you are eligible to use the Services and to detect and prevent fraud. You can control location permissions in your device settings, but some features may then be unavailable.
5.1 Account information. To open an account we ask for information about you, such as your legal name, email address, mobile phone number, address, date of birth, a government-issued identification document, and a Social Security number or other tax identification number. You promise that all information you give us is true, accurate, and complete, and you agree to keep it current.
5.2 Protecting your credentials. Keep your password and any other security details confidential. We will never ask you for your password. You are responsible for activity carried out with your credentials if you share them or fail to take reasonable care to protect them. Nothing in this section limits any protection the law gives you.
5.3 Verification codes. We may ask you to verify your identity when you sign in, when you use a new device, and from time to time when you use certain features, including by sending a code to your mobile phone by text message. You authorize us to send these messages to the number in your account. Message and data rates may apply.
5.4 Device biometrics. If you use your device’s fingerprint or face recognition to sign in to the Transi App, the biometric data stays on your device. We do not collect, receive, or store it.
5.5 Unauthorized use. If you suspect that your account, credentials, or device has been lost, stolen, or used without your permission, change your password and contact us immediately. We may suspend your account or restrict features to protect its security.
6.1 Why we verify. Federal and state laws require us and the Licensed Transmitter to verify the identity of the people who use money transmission services and to screen them against government sanctions lists. We verify your identity for ourselves and so that the Licensed Transmitter can meet its own legal obligations.
6.2 Your authorization. You authorize us, directly or through third-party providers, to make the inquiries we consider necessary to verify your identity and information. These may include asking you for further information or documents, confirming that you own your email address, phone number, and payment card, and checking your information against third-party databases. We may repeat these checks from time to time.
6.3 If you do not cooperate. You may not refuse to confirm your identity, to confirm information you gave us, or to cooperate in an investigation of activity that may violate the law or these Terms. If you do not give us the information we request, or if we cannot verify your identity, we may refuse, suspend, or close your account and you may not use the Services.
6.4 Inaccurate information. We may close the account of anyone who provides inaccurate, untrue, or incomplete information.
7.1 How a transfer works. To send money, you enter the amount, the recipient’s details, and the delivery method. Before you pay, we show you a pre-payment disclosure that states the amount to be sent, the fees, the exchange rate, any taxes we know of, the amount the recipient is expected to receive, and the date the funds will be available. Review it carefully. After you pay, you receive a receipt.
7.2 Your authorization. When you confirm a transfer, you authorize us and the Licensed Transmitter to process it and to charge the total amount shown in the pre-payment disclosure to your payment card.
7.3 Recipient information. You are responsible for entering the recipient’s information correctly. We and the Licensed Transmitter rely on the information you give us. If you enter an incorrect account number or other identifier, the funds may be delivered to the person that identifier belongs to, even if the name does not match, and may be difficult or impossible to recover. Section 12 explains what happens when a transfer cannot be delivered because of incorrect information.
7.4 Delivery. Payout partners in the destination country deliver the funds to the recipient. A recipient may be asked to show valid identification and a reference number. Delivery dates in the pre-payment disclosure and on your receipt are the dates the funds will be available to the recipient. Banks and other institutions that hold the recipient’s account may charge fees or apply their own rules, which we do not control. Taxes that apply in the destination country are included in your disclosure when we know them.
7.5 Limits and right to decline. We and the Licensed Transmitter may set limits on the amount and number of transfers. We may decline, delay, or hold a transfer, or ask you for more information, to comply with the law, to prevent fraud, or to manage risk. If we do not complete a transfer, we will refund it as the law requires, unless the law prohibits us from doing so.
7.6 Destinations and delivery methods. The destinations and delivery methods currently available are shown in the Transi App and may change from time to time.
7.7 Send money only to people you know. Use the Services only to send money to people you know and trust (see Section 15).
8.1 Accepted cards. You may pay for a transfer only with a debit card or credit card issued in your name. You promise that you are the authorized holder of the card and that you may make the payment.
8.2 Authorization. You authorize us and the Licensed Transmitter, and our payment processors, to charge your card the total amount of each transfer you confirm. Your card issuer may show a temporary hold before the charge is final. Card details are processed by our payment processors.
8.3 Charges by your card issuer. Your card issuer may charge you fees or interest on a transfer. For example, some credit card issuers treat a money transfer as a cash advance rather than a purchase. We do not control and are not responsible for those charges. Check your card agreement before you pay.
8.4 Declined payments. If your card is declined or the payment fails, the transfer is not sent. We will not try to charge your card again unless you confirm a new transfer.
8.5 Disputes with your card issuer. If you have a problem with a transfer, please contact us first so that we can help (see Sections 12 and 13). If you dispute a charge with your card issuer for a transfer that was properly completed, we may suspend your account and seek to recover the amount as allowed by law. Nothing in this section limits your rights under your card agreement or the law.
9.1 Fees. The fee for each transfer is shown in the pre-payment disclosure before you pay and is included in the total you pay. We will not charge you any additional fee for that transfer after you pay, other than fees that your card issuer or the recipient’s bank charge and that we do not control.
9.2 Exchange rates. If a transfer involves a currency conversion, the exchange rate that applies is shown in the pre-payment disclosure before you pay. The rate we or the Licensed Transmitter offer may be different from the wholesale rate and may include a margin. The disclosed rate is the rate that applies to your transfer.
9.3 Pricing information. Current pricing is available in the Transi App. Promotional offers have their own terms, which are shown when we offer them.
Before you pay, we give you a pre-payment disclosure. Immediately after you pay, we give you a receipt that repeats the key terms of the transfer and explains your rights to cancel the transfer, to report an error, and to contact a government agency. We deliver both electronically as described in Section 3, and you can save or print them. If a pre-payment disclosure or receipt is different from these Terms about the amount, fees, exchange rate, or delivery date of that transfer, the disclosure or receipt applies to that transfer.
11.1 Cancel within 30 minutes. You may cancel a transfer for a full refund if the Licensed Transmitter receives your request to cancel within thirty (30) minutes after you pay, it can identify the transfer, and the funds have not already been picked up or deposited. To cancel, use the cancel function in the Transi App or contact the Licensed Transmitter using the contact details on your receipt, and give the information needed to identify the transfer, such as the amount and the confirmation number.
11.2 Refund. If you cancel under Section 11.1, the Licensed Transmitter will refund the total amount you paid, including fees, to the card you used within three (3) Business Days after it receives your request. Your card issuer may need additional time to show the refund.
11.3 After 30 minutes. After the 30-minute period you may ask the Licensed Transmitter to cancel a transfer. It can cancel it only if the Licensed Transmitter Terms allow it and the funds have not been picked up or deposited. A transfer cannot be cancelled once the funds have been picked up or deposited.
11.4 Transfers that are not completed. If a transfer fails, is rejected, or cannot be delivered, the total amount you paid will be refunded to your card as the law requires.
12.1 Tell the Licensed Transmitter. If you think there is an error or a problem with your transfer, contact the Licensed Transmitter, which is responsible for investigating and resolving it, within 180 days of the date disclosed to you that the funds would be available to the recipient. Its contact details are on your receipt and in the Licensed Transmitter Terms. To make sure your notice reaches the right place, contact the Licensed Transmitter directly. If you contact Transi instead, we will promptly pass your notice to the Licensed Transmitter and tell you that we did.
12.2 What to tell them. Please give your name and address or phone number; the error or problem and why you believe it is an error; the name of the recipient and, if you know it, the recipient’s phone number or address; the amount of the transfer; and the confirmation number of the transfer.
12.3 What counts as an error. Errors include, as federal law defines them, an incorrect amount charged to you, an incorrect amount paid out to the recipient, a failure to make the funds available to the recipient by the date disclosed, and a failure to deliver the funds to the recipient you designated. It is not an error if the problem was caused by incorrect or incomplete information that you provided, but the Licensed Transmitter will explain what remedies are available to you.
12.4 The investigation. The Licensed Transmitter will investigate promptly and finish within ninety (90) days after you contact it. It will tell you the results within three (3) Business Days after it finishes. If it finds an error, it will correct it promptly at no additional cost to you, as the law requires, by refunding the amount that was not properly sent or by making the correct amount available to the recipient, and it will refund any fees and taxes paid for the part of the transfer that was affected. If it decides that there was no error, it will send you a written explanation. You may ask for copies of the documents it used in its investigation.
12.5 More information. You can contact the Licensed Transmitter at any time for a written explanation of your rights.
13.1 Where to complain. Complaints about the money transmission service, such as a transfer, a refund, or an error, go to the Licensed Transmitter, using the contact details on your receipt. Complaints about the Transi App, your Transi account, our customer support, or how we handle your information go to Transi Customer Support (Section 26). If you send us a complaint about a transfer, we will promptly pass it to the Licensed Transmitter and tell you that we did. When you complain to us, say clearly that you want to make a complaint. We will acknowledge it within five (5) Business Days, give you the name of a person who is your point of contact until it is resolved or cannot be taken further, and respond to the points you raise within fifteen (15) Business Days after we receive it and, in exceptional circumstances, within thirty-five (35) days.
13.2 Government agencies. If you are not satisfied with the response, you may contact the Consumer Financial Protection Bureau at 1-855-411-2372 or www.consumerfinance.gov/complaint, and the state regulator that supervises the Licensed Transmitter. The name and contact information of the state regulator appear on your receipt and in the Licensed Transmitter Terms.
You may not use the Services:
You are responsible for any losses, fines, penalties, and other liability that we, the Licensed Transmitter, or others incur because you breached this Section, to the extent permitted by law.
Criminals sometimes pose as officials, relatives, employers, or romantic partners to trick people into sending money. Send money only to people you know personally and trust. Be careful if someone you have not met in person asks you to send money, asks you to keep it secret, pressures you to act quickly, or asks you to pay with a card for a prize, a loan, a job, a debt, or a deposit. Once a transfer is picked up or deposited, we usually cannot get the money back. If you think you have been the victim of fraud, contact us immediately at 1-855-545-0925 and your card issuer, and report it to the Federal Trade Commission at reportfraud.ftc.gov.
16.1 Our rights. To comply with the law, to protect you and others from fraud, and to manage risk, we or the Licensed Transmitter may review your account and transfers; delay, hold, or stop a transfer; limit what you can do in the Transi App; and suspend or close your account. We may do so if you break these Terms or the Licensed Transmitter Terms, if we cannot verify your identity, if a regulator or law enforcement asks us to, or if our fraud and risk controls show a concern. We will tell you what we are permitted to tell you and, where we hold or stop a transfer, we will refund it as the law requires unless the law prohibits us from doing so. We will lift a suspension as soon as practicable after the reason for it has ended.
16.2 Closing or deleting your account. You may close and delete your account at any time at no cost, in the Transi App or by contacting us (Section 26). Any transfer in progress will be completed or cancelled as these Terms provide. We may delay closing your account if there is an open investigation, dispute, or legal hold, or if you owe us money. Closing your account does not affect obligations that arose before it was closed.
16.3 What happens to your information. When you close your account, we deactivate it and delete or anonymize your personal information in our active systems, and you may ask us to delete other personal information as our Privacy Policy describes. However, federal and state laws, including anti-money laundering, tax, and money transmission recordkeeping laws, require us and the Licensed Transmitter to keep certain information after an account is closed, such as records of your identity, your account, and your transfers. We keep that information for the period the law requires, which for Transi is at least ten (10) years after our relationship with you ends, and longer where the law or a legal hold requires. We store it securely and use it only for those legal purposes. We cannot delete it earlier, even if you ask. The Licensed Transmitter keeps its own records under its own legal obligations.
We may provide information about you and your transfers to government authorities, law enforcement agencies, and courts, and to our auditors and professional advisers, as required or permitted by law, as our Privacy Policy describes. We will report suspicious activity to the authorities when the law requires. Federal law may prohibit us from telling you that we have made a report or answered a request. We have no obligation to contest a court order or legal process involving you or your account.
Our Privacy Policy explains how Transi collects, uses, shares, and protects your information. The Licensed Transmitter has its own privacy policy that explains how it handles your information. You will be asked to accept both in the Transi App. We share your information with the Licensed Transmitter so that it can process your transfers and meet its own legal obligations.
You are responsible for reporting and paying any taxes that apply to your use of the Services. Transi does not provide tax advice. We may be required to report information about your transfers to tax and other authorities.
20.1 Transfers. If a transfer is not completed on time or in the correct amount, we and the Licensed Transmitter are responsible as the law provides, including for your actual damages that we proximately cause, to the extent the law requires. Nothing in these Terms excludes or limits our liability for fraud, gross negligence, or intentional misconduct, or any liability that the law does not allow us to exclude, or limits your rights under federal or state law, including your rights to a refund and to have errors resolved.
20.2 The Transi App. The Transi App and our website are provided “as is” and “as available,” without any promise that they will be uninterrupted or error-free. This does not limit our responsibility for transfers under Section 20.1.
20.3 Other limits. To the fullest extent the law allows, Transi, its affiliates, and their officers, directors, employees, and agents are not responsible for indirect, incidental, special, or consequential damages, or for loss of profits, arising out of your use of the Services, and our total responsibility to you for claims that these Terms do not otherwise address is limited to the amounts you paid us in the twelve (12) months before the claim arose. Some states do not allow these limits, so they may not apply to you.
20.4 Events beyond our control. We are not responsible for a delay or failure caused by events outside our reasonable control, such as natural disasters, power or network failures, acts of government, or the actions of third parties, as long as we take reasonable steps to limit their effect. This does not limit any right you have to a refund.
20.5 Your responsibility. You agree to reimburse us for losses, claims, and expenses, including reasonable legal fees, that we incur because you breached these Terms or the law, to the extent permitted by law. This does not apply to any claim for which the law protects you.
The Transi App, our website, and their content, software, designs, trademarks, and logos belong to us or our licensors and are protected by intellectual property laws. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Transi App and our website for your own non-commercial use as these Terms allow. You may not copy, modify, distribute, sell, reverse engineer, or create works from them, except as the law allows. We may use feedback you give us without obligation to you.
The Services may rely on or link to services provided by others, such as payment processors, identity verification providers, and payout partners. Their services are governed by their own terms, and we do not control them. Where the law makes us responsible for the acts of those who work on our behalf, these Terms do not limit that responsibility.
These Terms are governed by federal law and the laws of the State of New York, without regard to conflict of law rules, except where the law of the state where you live requires otherwise. The Licensed Transmitter Terms have their own governing law for the money transmission service.
24.1 Scope; talk to us first. This Section applies to disputes between you and Transi. Disputes with the Licensed Transmitter about the money transmission service are resolved as the Licensed Transmitter Terms provide, under their own governing law and dispute resolution terms. If you have a dispute with us, contact Transi Customer Support (Section 26). We will try in good faith to resolve it quickly. Nothing in this Section limits your right to complain to the Consumer Financial Protection Bureau or a state regulator.
24.2 Binding arbitration. If we cannot resolve a dispute within sixty (60) days after you raise it with us, either of us may require that it be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. This applies to any claim between you and Transi about the Services or these Terms, including questions about the scope or enforceability of this Section. The arbitrator may hold hearings by phone or video unless an in-person hearing is appropriate, in which case it will be held at a location reasonably convenient to you. We will pay the AAA’s filing, administrative, and arbitrator fees beyond what you would pay to file a claim in court. The Federal Arbitration Act governs this Section.
24.3 Class action waiver. To the fullest extent the law allows, you and we may bring claims only on an individual basis and not as a plaintiff or class member in a class, collective, or representative action. The arbitrator may not combine claims of more than one person. If this waiver is found unenforceable, the claim will proceed in court instead of arbitration.
24.4 Small claims and courts. Either of us may bring an individual claim in small claims court where you live. Any claim that is not subject to arbitration will be heard exclusively in the state or federal courts in New York, New York, and you and we consent to their jurisdiction, except where the law of the state where you live requires another venue.
24.5 Opt out. You may opt out of arbitration by sending an email to support@transiapp.com with the subject line “Opt-out from Arbitration” within thirty (30) days after you accept these Terms. Opting out does not opt you out of the class action waiver.
24.6 Severability of this Section. If any part of this Section other than the class action waiver is found unenforceable, the rest of it remains in effect.
25.1 Entire agreement. These Terms, the Privacy Policy, and the pre-payment disclosures and receipts you receive are our entire agreement with you about the Services, together with the Licensed Transmitter Terms for the money transmission service.
25.2 If part of these Terms is unenforceable. If a provision of these Terms is found invalid or unenforceable, it will be changed to the minimum extent necessary to make it enforceable, and the rest of the Terms will stay in effect.
25.3 No waiver. If we do not act on a breach of these Terms, we do not give up our right to act on a later or similar breach.
25.4 Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer these Terms, including to a successor or replacement of the Licensed Transmitter or of our business. If the Licensed Transmitter changes, we will tell you in advance and ask you to accept the new Licensed Transmitter Terms before you send another transfer.
25.5 Language. We may provide translations of these Terms for your convenience. If a translation differs from the English version, the English version controls, unless the law of your state requires otherwise.
25.6 Business Day. “Business Day” means Monday through Friday, excluding days on which Transi’s offices in the United States are closed for a federal holiday.
25.7 Notices. We may give you notices as described in Section 3. You may give us notices as described in Section 26.
